Terms & Conditions
These Terms & Conditions ("Terms") govern your use of Texnai's pages and services. By using our pages or engaging our services, you agree to these Terms. Texnai is a Gee Group platform based in the United Arab Emirates.
1. The service
Texnai designs, builds, and operates custom online stores for brands as a managed service. The specific scope, deliverables, and timelines for your store are set out in the agreement or order you enter into with us.
2. Eligibility and accounts
You must be able to enter into a binding contract to use our services. You are responsible for the information you give us and for keeping any access credentials secure. You are responsible for the activity that takes place under your account.
3. Fees and payment
Fees are as agreed in your order — typically a one-time setup fee and a fixed recurring subscription. We do not take a percentage of your sales. Card processing fees are charged separately by the payment provider on each sale. Unless stated otherwise, fees are exclusive of applicable taxes.
4. Your content
You keep ownership of the content, products, trademarks, and data you provide ("Your Content"). You grant us the permissions we need to host, display, and operate your store on your behalf. You are responsible for ensuring Your Content is accurate and does not infringe anyone's rights.
5. Our platform
We and our licensors own the platform, software, and systems used to build and run your store, along with our names, logos, and branding. Nothing in these Terms transfers that ownership to you.
6. Acceptable use
You agree not to use our services to break the law, infringe others' rights, send spam, upload harmful code, or interfere with the security or operation of our systems. We may suspend services that are used in these ways.
7. Third-party services
Our services rely on third parties such as payment, messaging, and infrastructure providers. Your use of those services may be subject to their own terms, and we are not responsible for their acts or omissions.
8. Availability
We work to keep your store available and fast, but we do not promise uninterrupted or error-free service. We may carry out maintenance, updates, and improvements from time to time.
9. Disclaimers
Our services are provided on an "as is" and "as available" basis, without warranties of any kind except those that cannot be excluded by law. We do not guarantee any particular sales, revenue, or business results.
10. Limitation of liability
To the extent permitted by law, Texnai is not liable for indirect, incidental, or consequential losses, or for lost profits, revenue, or data. Our total liability for any claim is limited to the fees you paid us for the service in the three months before the claim.
11. Indemnity
You agree to cover reasonable losses we incur because of Your Content or your breach of these Terms, to the extent permitted by law.
12. Termination
Either party may end the service as set out in your order. On termination, your right to use the service stops. Where your account is in good standing, we will help you with a reasonable handover of Your Content.
13. Governing law
These Terms are governed by the laws of the United Arab Emirates, and the courts of Dubai have jurisdiction over any dispute, without affecting any mandatory rights you have under local law.
14. Changes to these terms
We may update these Terms from time to time. When we do, we will change the effective date above. Your continued use of our services means you accept the updated Terms.
